POLICE-ORDERED VEHICLE REMOVAL RATES

Including Towaway, Driveaway, and Incident Response and Recovery Operations

Pursuant to 625 ILCS 5/4-203(g)(2), vehicle owners are responsible for all charges arising from vehicle removal ordered by law enforcement. The method of removal, including towing, driveaway, or recovery operations, is determined based on operational and safety considerations associated with law enforcement-ordered vehicle removal. Each registered or identifiable vehicle component, including tractors, trailers, or semi-trailers, and any unit possessing its own Vehicle Identification Number (VIN), constitutes a separate billable unit when removed, towed, hauled, transported, or stored.

When picking up your vehicle you will need

1.  Proof of Ownership (current registration or title)

2. Photo Identification (valid US Drivers license, state ID, military ID, or passport)

3. A release from from the police department if your vehicle is on hold

4. Payment in full (No personal checks will be accepted)

Retrieving Property From A Vehicle

By Illinois state law (625 ILCS 5/4-203) Any personal property belonging to the vehicle owner in the vehicle shall be subject to a possessor lien for towing services provided, excepting items defined by law. Personal property within or upon towed vehicles must be released to the vehicle owner upon demand after the owner has satisfied charges applicable up to that time.

Items that will be released (during normal business hours) without payment: Child safety restraint systems and booster seats; prescription eyeglasses; food and medications; medically necessary personal health or assistive devices, including hearing aids; perishable items; driver’s licenses; cash, credit or debit cards, checks, and checkbooks; wallets, purses, or similar items containing identification or financial documents; and higher education textbooks and study materials.

Items that will not be released until payment is made: radios, stereos (including speaker boxes and amps), battery or other engine or car parts, rims, tires, floor mats, electronics, clothing, shoes, and other item not listed under 625/ILCS 5/4-203.

We will only release property from a vehicle to the legal registered owner. There are no exceptions to this rule. You must be able to show valid identification and proof of current registration in your name to claim any property

YOU DO NOT HAVE OUR PERMISSION TO ABANDON YOUR VEHICLE UPON OUR PROPERTY!

Under (625 ILCS 5/4-201) of the vehicle code it is unlawful to abandon a vehicle in the state of Illinois and is subject to penalties under the law.

It is the policy of Naperville Classic Towing to pursue all means necessary to resolve your legal obligation. We have the right to take you, and all parties listed by the secretary of state to have an interest in the vehicle to small claims court. We also have the right to refer this matter to a collection agency for the balance owed. We will report any unpaid debt to credit reporting agencies.

POLLUTION PREVENTION – VEHICLE FLUID DISCHARGE POLICY

Petroleum-based vehicle operating fluids present a significant risk to public health, property, and the environment. Pursuant to the Illinois Environmental Protection Act (415 ILCS 5), which states that “no person shall cause or threaten or allow the discharge of any contaminants into the environment,” the Illinois Litter Control Act (415 ILCS 105), which defines “litter” to include oil and other discarded substances, and consistent with the Federal Clean Water Act (33 U.S.C. §1251 et seq.), vehicles are not permitted to discharge fluids while stored, transported, or handled on Classic Towing property or equipment.

Classic Towing maintains pollution prevention and secondary containment procedures to prevent the release of petroleum-based vehicle operating fluids during vehicle transport, handling, and storage operations. Any vehicle that is leaking or has the potential to leak petroleum-based vehicle operating fluids, will be fitted with a Spill Diaper™ Containment System. This containment system captures and controls fluid discharge from engines, transmissions, differentials, hydraulic systems, or other vehicle components that may release petroleum-based fluids.

The Spill Diaper™ system is a single-use containment device installed to provide secondary containment and prevent unlawful discharges while the vehicle is in the custody of Classic Towing. This containment measure helps mitigate potential environmental contamination and property damage and also helps protect the vehicle owner and their insurer from potential environmental liability and related costs associated with the discharge of petroleum-based vehicle operating fluids.

Each containment unit is single-use and departs with the vehicle upon release or transfer. Charges include containment materials, installation, monitoring, and handling.  Illinois law (625 ILCS 5/7-203) requires every driver to carry a minimum of $20,000 in property damage liability coverage per accident, which is intended to cover these types of costs.

This containment procedure is a standard environmental protection measure used during vehicle transport and storage operations to help ensure compliance with applicable environmental regulations and to protect surrounding property and infrastructure.

Under environmental law, the party responsible for the source of a contaminant is responsible for the costs associated with containment, cleanup, and any resulting environmental damage or regulatory enforcement actions. Proper secondary containment helps prevent releases that could otherwise result in environmental contamination and associated liability and cleanup costs for the responsible party.
